5.11 No identity‑based or circumstance‑based legal categories
Modern law is built on categories: tenants vs landlords, employees vs contractors, small business vs large business, married vs unmarried, homeowners vs renters, etc.
Under the NDP:
- These categories cannot be used to impose different rights or obligations.
- Law must be written in terms of actions, not identities or statuses.
- Entire branches of law (e.g., employment law, tenancy law) collapse into general contract and tort.
This radically simplifies the legal landscape.
No occupational licensing based on personal characteristics
Licensing regimes discriminate by:
- qualifications
- training hours
- background checks
- residency
- professional categories
Under the NDP:
- licensing must be replaced by universal safety standards
- no profession can be protected by barriers to entry
- guild‑like structures collapse
This dramatically increases competition and lowers costs.
